Introduction

Welcome to TheTCGMarket. These Terms of Service ("Terms") govern your access to and use of our trading card game marketplace platform. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

1. Definitions

  • "Platform" refers to TheTCGMarket website and services
  • "User" refers to anyone who accesses or uses the Platform
  • "Seller" refers to verified users who list items for sale
  • "Buyer" refers to users who purchase items
  • "Content" refers to listings, images, descriptions, and other information posted on the Platform

2. Eligibility

To use our Platform, you must:

  • Be at least 13 years of age
  • Be at least 18 years of age to become a Seller or make purchases
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations

3. Account Registration and Security

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password confidential
  • Be responsible for all activities under your account
  • Notify us immediately of any unauthorized access
  • Not share your account with others
  • Not create multiple accounts

4. Seller Requirements and Obligations

4.1 Verification

To become a Seller, you must:

  • Complete our seller verification process
  • Connect a valid PayPal account for payments
  • Provide accurate business or personal information
  • Maintain good standing on the Platform

4.2 Listing Requirements

Sellers must:

  • Only list items from our official catalog
  • Provide accurate information in all listing fields
  • Set fair and accurate prices
  • Maintain accurate inventory quantities
  • Honor listed prices and availability

4.3 Fulfillment Obligations

When a sale is made, Sellers must:

  • Ship items within a reasonable timeframe (typically 3-5 business days)
  • Package items securely to prevent damage
  • Provide accurate tracking information when available
  • Ship the exact item as described in the listing
  • Communicate promptly with buyers regarding any issues

4.4 Seller Fees

Sellers agree to pay:

  • Platform fees as displayed at the time of listing
  • PayPal processing fees as determined by PayPal
  • Any applicable taxes on their sales

Fees are automatically deducted from sale proceeds. We reserve the right to modify fees with 30 days notice.

5. Buyer Obligations

Buyers agree to:

  • Pay for items purchased through the Platform
  • Provide accurate shipping information
  • Communicate respectfully with Sellers
  • Not file fraudulent chargebacks or refund requests
  • Allow reasonable time for shipping and delivery
  • Report issues through proper channels

6. Payments and Transactions

6.1 Payment Processing

  • All payments are processed through PayPal
  • We do not store payment information or credit card details
  • Buyers pay at the time of purchase
  • Sellers receive payment after successful order completion

6.2 Platform Role

TheTCGMarket acts as a marketplace platform connecting buyers and sellers. We facilitate transactions but are not a party to the sale. Sellers are responsible for fulfilling orders, and buyers are responsible for payment.

6.3 Pricing

  • All prices are in USD unless otherwise specified
  • Prices include platform fees but exclude shipping costs
  • Sellers set their own prices within reasonable market ranges
  • Prices are final once an order is placed

7. Returns, Refunds, and Disputes

7.1 Return Policy

Each seller selects their own return policy when listing items on our platform. Sellers are required to honor the return policy they have selected. Buyers should review the seller's return policy before making a purchase.

Returns and refunds are handled directly between buyers and sellers. TheTCGMarket does not manage the return process, issue refunds, or mediate disputes. Unlike larger marketplaces, we do not offer a buyer protection program or guarantee. However, all transactions are processed through PayPal, which provides its own buyer and seller protection programs to help resolve disputes.

7.2 Dispute Resolution

If you have an issue with an order:

  • Contact the seller directly to resolve the issue according to their stated return policy
  • Work together to reach a resolution (refund, replacement, partial refund, etc.)
  • If unable to reach an agreement, you may utilize PayPal's buyer protection and dispute resolution features
  • If the seller is not honoring their stated return policy, you may contact our support team at support@thetcgmarket.com

Our support team may assist with facilitating communication between parties, but we do not have authority to enforce refunds or make final decisions on disputes. The transaction is between the buyer and seller.

7.3 PayPal Protection

All transactions are processed through PayPal, which offers its own buyer and seller protection programs. We encourage users to familiarize themselves with PayPal's policies and utilize their dispute resolution services when necessary.

7.4 Chargebacks and Payment Disputes

Users should attempt to resolve disputes directly with the other party and through PayPal's dispute resolution process before initiating chargebacks. Filing fraudulent chargebacks or payment disputes may result in account suspension or termination.

8. Prohibited Conduct

Users may not:

  • List or sell counterfeit, stolen, or unauthorized items
  • Manipulate prices, feedback, or ratings
  • Engage in fraudulent or deceptive practices
  • Harass, threaten, or abuse other users
  • Attempt to circumvent platform fees or policies
  • Use the Platform for money laundering or illegal activities
  • Scrape, data mine, or use automated tools without permission
  • Impersonate others or create fake accounts
  • Interfere with Platform operations or security
  • Violate intellectual property rights

9. Intellectual Property

9.1 Platform Content

The Platform, including its design, functionality, and TheTCGMarket trademarks, is owned by TheTCGMarket and protected by intellectual property laws. Product catalog data is sourced from third-party providers and is subject to their respective terms and conditions. You may not copy, modify, or distribute Platform content without permission.

9.2 Seller Listings

By creating listings on the Platform, sellers grant TheTCGMarket permission to display those listings to buyers. All listings must comply with our policies and applicable laws.

9.3 Trading Card Trademarks

Product names, images, and trademarks belong to their respective owners (e.g., Pokémon, Magic: The Gathering, Yu-Gi-Oh!). We use these for identification purposes only and do not claim ownership.

10. Account Suspension and Termination

10.1 Our Rights

We reserve the right to:

  • Suspend or terminate accounts that violate these Terms
  • Remove listings that violate our policies
  • Withhold payments for fraudulent activity
  • Ban users permanently for serious violations
  • Take legal action when necessary

10.2 Your Rights

You may close your account at any time by contacting support. Upon account closure, you remain responsible for any outstanding obligations, fees, or disputes.

11. Disclaimers and Limitation of Liability

11.1 Platform "As-Is"

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that the Platform will meet your needs.

11.2 Third-Party Transactions

We are not responsible for the quality, safety, legality, or authenticity of items listed by Sellers. Transactions are between buyers and sellers. We do not guarantee that sellers will fulfill orders or that items will meet buyer expectations.

11.3 Limitation of Liability

To the maximum extent permitted by law, TheTCGMarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from your use of the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in fees during the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless TheTCGMarket, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post on the Platform
  • Transactions between you and other users

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class arbitrations.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Platform and may close your account.

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and TheTCGMarket regarding your use of the Platform.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

15.4 Assignment

You may not transfer or assign your rights or obligations under these Terms. We may assign our rights and obligations without restriction.
